1. Agreement

By booking an appointment, purchasing a program or subscription, accessing content on our Coachful platform, or otherwise engaging our services, you agree to be bound by these Terms.

2. Scope of Services & Professional Disclaimers

Unpolished Sobriety delivers peer-based recovery coaching, behavioral accountability, one-on-one sessions, group workshops, structured digital content, downloadable guides, and ongoing client communication.

Non-Clinical Peer Support: Coaching is a client-driven personal and professional development partnership. It is not licensed psychotherapy, psychiatry, medical care, clinical addiction medicine, financial planning, or legal advice.

No Doctor-Patient Relationship: Participation in coaching does not create a therapist-patient, doctor-patient, or fiduciary healthcare relationship.

Emergency Situations: Our communication channels and coaching portal are not monitored 24/7 and are not designed for emergency response. If you are experiencing an acute medical emergency, mental health crisis, or thoughts of self-harm, immediately call or text 988 (in the United States), contact local emergency personnel (911), or go to the nearest emergency medical facility.

3. Financial Terms & Payment Processing

Fees & Currency: All fees are clearly stated at checkout in US Dollars (USD) unless otherwise designated. You authorize Unpolished Sobriety to charge your selected payment method for the full purchase price or scheduled payment plan.

Payment Gateways: Transactions are handled through PCI-compliant third-party processors (such as Stripe). We never collect or store complete debit or credit card numbers.

Subscriptions & Installments: By opting into a membership tier, subscription, or installment payment schedule, you authorize automated, recurring billing until the obligation is satisfied or you submit a formal cancellation request.

Taxes: Clients are responsible for any applicable local sales taxes, use taxes, or banking transaction fees associated with their purchases.

4. Attendance, Scheduling & Cancellations

Cancellation Window: Sessions may be rescheduled or canceled without penalty up to 24 hours prior to the scheduled session start time via the client portal.

Late Cancellations & Missed Sessions: Cancellations made fewer than 24 hours in advance, or failure to join a scheduled session within 15 minutes of the start time (no-shows), will result in forfeiture of the session without credit or rescheduling.

Coach Rescheduling: In the rare event that Unpolished Sobriety must reschedule an appointment due to unforeseen circumstances, you will be notified promptly and offered the earliest feasible alternative time.

5. Refund & Return Policies

1:1 Coaching Sessions: Single sessions and prepaid bundles are eligible for a refund only if canceled prior to the 24-hour scheduling deadline. Once a session has concluded, it is fully delivered and non-refundable.

Digital Products & Instant Downloads: Because digital assets, workbooks, video modules, and templates are instantly accessible upon purchase, all sales of digital goods are final and non-refundable once download or portal access has occurred.

Group Cohorts & Multi-Week Programs: Group program purchases are subject to the specific withdrawal terms published on the program checkout page. Unless explicit guarantees are provided, program fees are non-refundable after cohort kick-off.

Recurring Subscriptions: You may cancel an ongoing subscription at any time via your account portal. Cancellation takes effect at the end of the current billing cycle, halting future renewals. Past billing periods are non-refundable.

6. Client Responsibilities & Code of Conduct

As a client of Unpolished Sobriety, you agree to:

Arrive at scheduled video calls on time, sober, and ready to engage constructively.

Maintain a respectful, civil tone during private sessions and within any shared group spaces or community boards.

Provide accurate, truthful information during onboarding assessments and check-ins.

Implement insights, habits, and action plans at your own discretion, recognizing that personal progress requires personal application.

Keep all shared program materials, templates, worksheets, and peer discussions strictly confidential.

7. Intellectual Property

All proprietary methodologies, written articles, audio recordings, video lectures, workbooks, visual graphics, and digital downloads provided through Unpolished Sobriety and the Coachful platform remain the exclusive intellectual property of Unpolished Sobriety.

You receive a limited, revocable, non-exclusive, non-transferable personal license to view and apply these assets for your own personal growth. You may not reproduce, resell, republish, distribute, share logins, or create derivative works from these proprietary materials without prior written consent.

8. Client Confidentiality

We treat personal disclosures, session dialogue, and written reflections made during private coaching as strictly confidential. Information will not be released to external parties without your prior consent, except under the following legally mandated exceptions:

Evidence of imminent danger or serious threat of physical harm to yourself or another person.

Knowledge or suspicion of child abuse, neglect, or vulnerable adult abuse, in accordance with applicable statutory reporting duties.

Receipt of a valid court order or legally binding subpoena.

9. No Guarantees or Warranties of Outcome

Coaching is inherently collaborative and self-directed. Unpolished Sobriety provides guidance, structure, frameworks, and accountability, but we do not guarantee specific personal, behavioral, or recovery outcomes. Individual progress depends entirely on personal effort, consistency, external support systems, and circumstances outside our control.

10. Limitation of Liability

To the fullest extent permitted by law:

Unpolished Sobriety, its owners, and its contractors shall not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from your use of, or inability to use, our services or materials.

Our total cumulative liability for any claim, cause of action, or dispute arising out of or related to these Terms or our services shall not exceed the total fees paid by you to Unpolished Sobriety in the twelve (12) months preceding the claim.

11. Termination of Services

We reserve the right to suspend or permanently terminate your account, session bookings, or community access at our sole discretion if:

You breach these Terms or platform conduct standards.

You fail to pay scheduled invoices or maintain valid billing details.

You engage in abusive, harassing, or disruptive behavior toward the coach or fellow community members.

12. Modifications to Terms

We reserve the right to adjust or update these Terms to reflect operational, commercial, or regulatory changes. Updated versions will be posted to the Coachful platform with a revised "Last updated" date. Continued participation in coaching or use of the website following changes constitutes agreement to the updated Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.

In the event of any disagreement or dispute, both parties agree to first attempt resolution in good faith via direct informal consultation. If the dispute cannot be resolved informally within thirty (30) days, the parties agree that exclusive jurisdiction and venue shall lie in the state or federal courts located within Polk County, Florida.
